The law firms of Sotos LLP ("Sotos") and Goldblatt Partners LLP (formerly Sack Goldblatt Mitchell LLP) have commenced a class action against Bell Mobility Inc. and Bell Canada Enterprises Inc. alleging that the expiry dates imposed on the credit balances of their pre-paid wireless customers breach the terms of service and are in violation of Ontario’s Consumer Protection Act. The lawsuit demands that the money be returned and that this practice stop.
The detailed allegations (which have yet to be proved in court) and claim for relief are set out in the Statement of Claim.
This case is being brought by Celia Sankar, a social justice advocate, on behalf of all persons in Ontario who who purchased or acquired pre-paid mobile telephone services from the defendants, sold under the brand names: Bell Mobility, Virgin Mobile Canada or Solo Mobile, from May 4, 2010.
A judge of the Ontario Superior Court will decide whether this case is to be “certified” as a class proceeding. If you believe you are a member of the proposed class, you are invited to register to be advised about developments in this case. There is no requirement that you do so. If you do register, we will keep your information confidential.
Whether or not you register, we strongly advise you to keep copies of any records relevant to your individual claim. Class actions can take a long time to resolve and the more time that passes, the more difficult it can be to obtain records.
